Legal transcription in 2026: what's actually changed

For decades, the standard workflow for converting a deposition or court hearing into text meant booking a certified court reporter, paying $4–7 per page, and waiting 3–10 business days for delivery. That model still has its place — certified, signed transcripts are required for filing in most jurisdictions — but a huge fraction of the work that used to require it doesn't anymore. Internal case prep, fact-discovery review, witness preparation, expert-witness audio review, even the rough draft a paralegal hands to the court reporter for verification — all of that can now run through AI transcription at roughly 1/30th the cost and 1/100th the latency.

What changed is accuracy. As of 2026, modern asr">ASR engines (built on OpenAI's whisper">Whisper family and successors) achieve 95–97% wer">word error rates on clean legal audio — comparable to a junior court reporter on the first pass. Where AI struggles is the same place humans do: cross-talk, sotto voce asides, accented speech, and proper nouns (case names, client names, exhibit numbers). For internal use that 3–5% gap is fine; for filing it still requires a human review pass.

Privilege, confidentiality, and ABA Model Rule 1.6

Legal audio is privileged or confidential almost by definition. ABA Model Rule 1.6(c) requires lawyers to make "reasonable efforts" to prevent unauthorized disclosure. That obligation applies to the AI vendors you choose. Two things to verify with any transcription tool:

1. Audio retention policy. On Transcript.you, uploaded audio is processed once and deleted from our servers immediately after the transcript is generated — we never persist client audio. The text result is retained only if you're signed in (and only for your account).
2. Training-on-user-data policy. We do not train any model on user-uploaded audio or transcripts, full stop. (Some major consumer transcription tools do, by default — read the ToS.)

For matters that require a stricter chain of custody (criminal defense, regulatory investigations, anything HIPAA-adjacent), pair AI transcription with a secured storage location for the final transcript and document the workflow in your matter file.

Output formats lawyers actually use

For internal case-prep work the format that matters most is plain text with line numbers and timestamps — drop into Westlaw, Lexis, Casetext, or a Word doc and search in seconds. We export to:

• TXT with optional inline timestamps — best for keyword search across thousands of pages of depo audio
• DOCX with paragraph numbering — useful for shared review with co-counsel and pre-filing review
• SRT / vtt">VTT — required only when audio is being shown at trial with synchronized captions

FAQ for legal teams

Can the AI transcript be used as evidence at trial? Generally, no — courts require certified transcripts produced by a licensed court reporter. Use AI transcripts for prep and discovery work, then have the formal record certified separately. A growing number of jurisdictions accept AI-assisted transcription if a CCR signs off, but practice varies.

Does this work for multi-speaker audio? Yes, but not perfectly. Standard ASR identifies that speakers changed without always labeling who. Our Speaker ID feature adds Speaker 1 / Speaker 2 / Speaker 3 labels — usually accurate enough to follow a deposition without a separate review pass for attribution.

What about heavy accents or non-English depositions? Whisper-3 supports 50+ languages with strong accuracy on Spanish, Mandarin, Tagalog, and the major European languages.
